In addition to the Residential Arizona Standard Lease attached, which provides for the protection of both tenant and landlord, tenant agrees to adhere to the laws of the state of Arizona, the Arizona Tenant and Landlord Act, and the following Addendum.

All written leases, addendum, notices and other documents signed by tenant or landlord and delivered either by person, mail or email shall go into effect within 30 days in absence of receiving party signature or response. Any writing which is added, removed or otherwise changed by receiving party must be initialed by both parties to be valid.

RENT: Rent is due on the first of the month. Late fees are $7 per day. There is a 3 day grace period, however if rent is not paid by the 3rd, tenant shall pay $21 plus $7 per day thereafter that rent is not paid in full, including all utilities and other fees owed to landlord. If you pay by the 25th of the previous month, you may deduct $10.

If landlord owes tenant any money, it will be done in separate transactions. Tenant shall never deduct fees owed from rent. Any such deductions shall constitute rent not being paid in full and late fees shall be applicable.

Tenant shall notify landlord if tenant is going to be late paying rent, prior to delinquent date. If rent is late, tenant shall automatically add late fees to rent as stated in lease.

Tenant shall report any job change or ability to pay rent to landlord.

If landlord has not received rent from tenant by the 14th day of the month, and tenant has not made satisfactory arrangements with the landlord for rent payment, tenant agrees to vacate premises and leave leased premises in move in condition within 24 hours. If tenant does not do so by the 15th day of the month, tenant agrees to forfeit all security deposit and final month’s rent and utilities and gives landlord the right to remove all of tenant’s personal belongings, to place all tenant’s furniture next to the street for tenant pick up and hold all other personal belongings at the rental property for 48 hours, with cost of move out being paid by tenant. Tenant shall pick up any items desired within 48 hours and gives landlord the right to dispose of any items not retrieved in that time period. If leased space is not in move in condition, tenant agrees to pay for clean up. Tenant is responsible for the rent to the end of lease period regardless of actual move out date.

Advertised rental rate is in effect when tenants do one of the following:
a) Prior to move in, give landlord post dated checks for the first six months of rent and utilities, dated for the first day of each consecutive month and continue to do so every six months.
OR b): tenants who consistently pay rent on time, (i.e. rent is received by landlord by the first day of each month via direct deposit).
Otherwise, rent is $25 more than the rents stated below, and tenant shall direct deposit rent into landlords account as given below.

LEASE TERM:
Trial Period: The first 14 days shall be considered a trial period and lease may be terminated by tenant or landlord for any reason during that time. If lease is terminated, tenant’s rent will be prorated, and must be completely moved out within the 14 day period, leaving suite in move in condition. After trial period, all tenant leases are for six month minimum, starting from the first day of the month following move in. Tenant may terminate lease prior to that time providing that tenant finds a new tenant with no lapse in rent between tenants, which applies to landlord and is approved by landlord for a new six month or longer lease.

NUMBER OF PEOPLE ON PROPERTY:
Maximum one tenant per suite.
No overnight guests.

NOISE: No noise after 10:00 p.m. and prior to 8:00 a.m.
No loud music, tools, automobiles, etc., on the property, inside or out.

PETS: No Pets, other than legally authorized assistive working animals are allowed on the property at any time, either owned by tenant or a guest unless prior arrangements have been made between landlord and tenant. If pet is allowed, add $25 per month per pet to rent, plus $150 refundable pet deposit. Pets will only be allowed so long as they do not disturb other tenants. All pets must be kept indoors and all pet waste must be cleaned up immediately. Fine for unauthorized pets: $25/day.

SMOKING: No Smoking at any time on the property, inside or outside.

No outdoor storage of anything except appropriate patio/garden furniture and grill. Bicycle storage will be allocated upon request. No boats, trailers, RV’s, Etc.

PARKING: Parking on the property is very limited and therefore, only registered tenant vehicles are allowed on property. Max one vehicle per tenant on property. No parking on private road (dirt portion of Forest Rd). Guests may park on lower Forest Rd. pavement across from Hyatt. All tenants will be assigned a private parking space as designated below and shown on attached diagram.
Leave turn around space vacant at all times. Turn around space is at the foot of driveway entrance.
If tenant has more than one vehicle, tenant shall find alternative parking for other vehicles. Tenants shall not park trailers, boats, RV’s, etc, on the property, nor store anything outside.

LANDLORD’S RIGHT TO ENTER PROPERTY: Landlord shall give tenant notice to enter tenant’s rental space as follows:

Regular Maintenance: 24 hours.
Repair or urgent safety issues: Will try for 24 hours notice, but may be shorter notice if necessary.
Emergencies or access to exterior or common space: No notice is necessary.

SHOWING PROPERTY: Upon the giving of notice of lease termination either by tenant or landlord, tenant agrees to show tenant’s leased suite or to allow landlord access to rental space to show to prospective tenants with 24 hour notice.

MAIL: Prior to move in, tenant agrees to acquire a P.O. Box number or other family address where tenant will permanently receive mail. Tenant agrees not to receive mail at the rental property address except in the case of packages or mai
l which can not legally be sent to a P.O. Box. If tenant cannot acquire P.O. Box prior to move in, tenant will set aside $50 with landlord which shall go towards a P.O. Box within the first 30 days.

UTILITIES: Tenant’s are responsible for all utilities. Gas, electricity, water, insect control, cable t.v. and trash pick up shall be in landlord’s name. Landlord shall collect $100 from each tenant due at the beginning of each month which s
hall go towards the payment of these utilities. Should utility payments exceed the amount collected, tenants are responsible for the difference. Tenants are to use evaporative cooler when possible.
Other services which are desired by tenants, such as internet services, land line phones, rodent control, etc, shall be purchased by tenants. Tenants may form a pool to pay for such services collectively.

Maintenance of Common Areas and windows shall be provided to tenant at a cost of approximately $25/mo:
LANDSCAPING: including weed control, trash pick up, watering plants.
Maintenance of outdoor lighting and common space lighting.
Changing of air conditioner filters once a month when in use.
Cleaning of waste water filters.
Keep driveway swept once a month.
Windows washed each six months.

IF YOU SHARE A BATHROOM:
Tenants should be respectful of one another’s need for bathroom time. Anything that does not need to be done in the bathroom, for example, hair drying, should be done in the bedroom so as to give the other tenant more access to the bathroom. Bathroom should be maintained clean and free of clutter at all times. All personal items are to be kept in tenant’s private space. It is strongly recommended that if you share a bath, you work out a usage schedule with the other tenant by choosing a regular 20-30 minute period when you want to have the bathroom each day. That should eliminate tenants trying to get into the bathroom at the same time. Tenants agree to clean bathrooms thoroughly at least once a week.

CONDUCTING A BUSINESS: Tenants are not allowed to conduct a business from the rental property which involves business associates such as clients or co-workers coming to the property, or involves noise or smells which may disturb other tenants or neighbors.

PRIVACY: Tenants shall never enter another tenant’s leased space or borrow items without consent.

SALE OF PROPERTY: Landlord has the right to sell property. Should a prospective buyer require to see the property, tenant shall cooperate by showing his/her leased space with 24 hour notice by landlord. 24 hour notice begins once landlord has contacted tenant in any manner, including time of email or time of voice mail.

Please note, while landlord has the right to sell property, the said property is not currently listed for sale, nor does landlord have the intention of selling property anytime soon. Please keep in mind, that if the house is attractive as a rental to a prospective buyer, in other words, all tenants are paying rent on time and keeping property clean, the likelihood of a buyer wanting the property to continue as a rental will be high. If you like living at this property, and want to keep it as a rental property, please pay your rent on time and keep the property clean and neat!
